Business Plan Services Agreement
By receiving Write On Point services, you the Client and Write On Point, Inc., a business consulting firm based at 1014 36th Street, Baltimore, MD 21211 agree as follows:
TURN-AROUND TIME
The turnaround time indicated within your Proposal applies to the sending of the initial draft of the business plan, not on the turnaround time for completion.
Turn-around times for completion of the final documents vary based on (a) how much additional information we need to complete the order, (b) how many drafts we create, and (c) how much time it takes to communicate back and forth with the Client.
Additionally, we do periodically receive a significant number of orders in a short period of time. This can result in some delays, though we continue to prioritize orders that have been expedited.
Turnaround time shall start upon receipt of payment unless we are waiting for information from the Client that is necessary to complete the business plan.
PAYMENT TERMS
Client shall pay, in full, the price of the services ordered with no additional sums, taxes, or charges. A 50% payment is required before starting work on Client business plan projects.
Typically, business plans are provided for a flat-fee. If you are provided a service with an hourly rate, you will be notified in advance, and the rate will be $105/hour.
A late fee of 1.5% per month will be assessed for any payment not received on the due date.
Write On Point may terminate agreement for non-payment of invoices more than 30 days past due.
Failure to promptly correct past due balances will result in a late fee, and after 60 days your account may be sent to a collection agency, for which you agree to pay all handling, collection, and legal costs. Unresolved payment may also be reported to credit bureaus.
REVISIONS
Write On Point offers unlimited revisions for unfinished orders until Client approves the final copy.
Revision refers to editing content that matches the objective stated by the Client in the initial interview and/or questionnaire. If Client changes the business plan objective during revision, Client must pay an additional fee for the intended business plan change.
SERVICE EXPIRATION
All uncommenced and unfinished orders, due to Client failure to communicate and/or provide information, shall expire within three (3) months from payment.
Client shall be allowed to continue with their unfinished or uncommenced project within three (3) months regardless of the service purchased.
If Client requests reactivation and completion of the order beyond the expiration date, Client must pay a reactivation fee that depends upon the services requested. Payment of this reactivation fee will then mean the continuation of work on the purchased service and completion within the original turnaround timeframe.
If the project has expired for 1 year or more, the Client must re-order the service.
BUSINESS PLAN UPDATE
Business Plan Update refers to the change, addition, or removal of business plan content such as milestones, personnel, and/or the latest financials, among others after the 1-year completion date of the original business plan.
REFUND
The products and/or services provided by Write On Point, Inc. are designed and tailored for each Client. As such, they are considered a set of creative products and services and are non-refundable, except when required by law.
If additional changes are required AFTER delivery and approval of the final project, such changes will be subject to an additional fee.
Specifically, no refund shall take effect under any of these circumstances:
Certain refund requests may be considered by Write On Point on a case-by-case basis and granted at the sole discretion of Write On Point.
NATURE OF OUR SERVICES
Write On Point is not a law firm and does not provide legal advice. Write On Point provides consultation services to Clients that include providing documents and information to assist in their business endeavors.
Information provided by Write On Point is not a substitute for legal advice from an attorney licensed to practice in the appropriate jurisdiction. Your use of Write On Point services does not create an attorney-client relationship between you and Write On Point or between you and any Write On Point employee or representative.
PRIVACY
Write On Point shall ask only for information needed to deliver the service(s) ordered by Client. Neither party may, at any time, use or disclose confidential information relating to past, present or future business, terms, customers, employees, financial data, operations, practices, products, processes, features, sales or services of the parties to anyone outside of this Agreement. We agree not to disclose your information, unless ordered by a court of law, or you have a written consent for us to do so.
WARRANTY DISCLAIMERS
Write On Point works in good faith to write and design your business plan and other documents based on the data you provided. However, no guarantee of receipt of funding by the Client is implied or promised by Write On Point and payment is due even if Client does not submit proposals or receive a grant and/or funding.
Client must review their documents for accuracy and shall inform Write On Point through email if the Client approves the copy or wants to have it revised. Failure to notify Write On Point of the corrections or approval within the specified time shall deem Write On Point to recognize the copy as final.
Write On Point shall not be responsible for any missed deadline if you fail to provide information in a timely manner. Moreover, if you fail to approve the copy, we are not liable for the delay of the project.
ACCURACY OF INFORMATION
You warrant that you own and control the rights to the content you provide to Write On Point, Inc. You agree that you will only send us true, accurate, and exact data. As such, you will protect us from all third-party claims that result from the data you supply.
When you submit your data to us, you grant us inclusive and royalty-free rights. You give us full access to use, edit, publish, translate, and display such content subject to our Privacy Policy.
TECHNOLOGY
We use e-mail to communicate with you. This ensures exact information and preserves the thread of communication. As we use MS Word, and PDF formats, we cannot ensure that your copy will keep the format and features on your equipment.
We cannot give technical support on compatibility issues because of computer software and devices you use.

- Client approved the draft per email exchange with their writer;
- The service has been ended for reasons unrelated to Write On Point;
- Write On Point did not hear from Client for over three (3) months; and/or
- Client has utilized the finished product fully at the time of the request for refund (e.g. used the business plan to apply for a loan or grant).
